The Federal Protective Service (FPS) is the premier provider of security and law enforcement services at U.S. federal government facilities. FPS plays a leading role in the protection of our nation’s critical infrastructure, with lead responsibility for ensuring a safe and secure working environment for federal workers and visitors in approximately 9,000 federal facilities nationwide.

The Federal Protective Service (FPS) and the General Services Administration (GSA), the two agencies charged with protection of federal facilities, have made “limited progress” in improving collaboration, which may be putting these facilities at risk, according to a recent Government Accountability Office (GAO) report.

FPS has primary responsibility for protecting federal facilities held or leased by GSA and their occupants. GSA serves as the federal government’s “landlord” by designing, building, and managing these facilities and fixing security issues. Both agencies conduct policy making and high-level planning at the headquarters level.

FPS and GSA Should Strengthen Collaboration to Enhance Facility Security

What GAO Found

The Federal Protective Service (FPS), within the Department of Homeland Security (DHS), and the General Services Administration (GSA) have taken some steps to improve collaboration, such as drafting a joint strategy. While each agency has some individual policies for collaboration, the two agencies have made limited progress in agreeing on several key practices as described below. Reaching agreement on these practices will help to enhance the agencies’ ability to protect federal facilities and to improve day-to-day operations at the regional level.

As a result of not having key practices in place, regional officials said they were not aware of agreed upon collaborative policies and procedures to conduct day-to-day operations. GAO found that this created inefficiencies and security risks. For example, FPS officials told GAO that GSA did not coordinate with them on new construction intended for law enforcement tenants, and as a result, it was not suitable for law enforcement use. GSA officials told GAO that they did not have sufficient information from FPS about security plans for upcoming events and, therefore, were not able to inform tenants of necessary security measures.

GAO made four recommendations to improve collaboration between FPS and GSA. The recommendations include:

  • FPS and GSA headquarters officials should establish a plan with time frames for reaching agreement on a joint strategy and finalizing it in order to define and articulate a common understanding of expected outcomes and align the two agencies’ activities and core processes to achieve their related missions;
  • FPS and GSA headquarters officials should establish a plan with time frames for reaching agreement on the two agencies’ respective roles and responsibilities for federal facility security, and update and finalize the two agencies’ MOA accordingly;
  • FPS and GSA headquarters officials should develop a process to ensure that compatible policies and procedures, including those for information sharing, are communicated at the regional level so that regional officials at both agencies have common information on how to operationalize the two agencies’ collaborative efforts; and
  • FPS and GSA headquarters officials should develop mechanisms to monitor, evaluate, and report on their collaborative efforts to protect federal facilities in order to identify possible areas for improvement and to reinforce accountability.

Mr. Chairman and Members of the Committee: We are pleased to be here to discuss the results of our report on the Federal Protective Service’s (FPS) contract guard program, issued April 13, 2010.1 As you are aware, FPS—within the National Protection and Programs Directorate (NPPD) of the Department of Homeland Security (DHS)—is responsible for protecting the buildings, grounds, and property that are under the control and custody of the General Services Administration (GSA), as well as the persons on the property; authorized to enforce federal laws and regulations aimed at protecting GSA buildings and persons on the property; and authorized to investigate offenses against these buildings and persons. To accomplish its mission of protecting federal facilities, FPS currently has a budget of about $1 billion,3 about 1,225 full-time employees, and about 15,000 contract security guards (guards) deployed at about 2,360 federal facilities across the country. In fiscal year 2009, FPS obligated $659 million for guard services, which represents the single largest item in its budget.

FPS’s contract guard program is the most visible component of its operations as well as the first public contact for individuals entering a federal facility. FPS relies heavily on its guards and considers them to be the agency’s “eyes and ears” while performing their duties. Guards are primarily responsible for controlling access to federal facilities by (1) checking the identification of government employees as well as members of the public who work in and visit federal facilities, and (2) operating security equipment, such as X-ray machines and magnetometers to screen for prohibited materials, such as firearms, knives, explosives, or items intended to be used to fabricate an explosive or incendiary device. Guards do not have arrest authority but can detain individuals who are being disruptive or pose a danger to public safety.

This testimony, based on our report, discusses challenges FPS continues to face in (1) managing its guard contractors, (2) overseeing guards deployed at federal facilities, and (3) actions FPS has taken to address these challenges. Our methodology included site visits to 6 of FPS’s 11 regions. To select these 6 regions, we considered the number of FPS guards, contractors, and federal facilities, and the geographic dispersion of the regions across the United States. At each region, we observed FPS’s guard inspection process and interviewed FPS’s regional manager, contract guard program managers, inspectors who are responsible for conducting guard inspections; guards, and contractors. We also randomly selected 663 out of approximately 15,000 guard training records that were maintained in FPS’s Contract Guard Employment Requirements Tracking System (CERTS) and/or by the guard contractor and validated them against the contractual requirements that were in effect at the time of our review. We also reviewed the contract files for 7 of FPS’s 38 guard contractors. We selected these 7 contractors because our previous work showed that they had contract compliance issues. In addition, we analyzed a random sample of 99 FPS contractor evaluations to determine how FPS evaluated the performance of its contractors on an annual basis.

We also reviewed new contract guard program guidance issued since our July 2009 testimony and observed guard inspections and covert testing done by FPS in August and November 2009.6 Because of the sensitivity of some of the information in our report, we cannot provide information about the specific locations of the incidents discussed. We conducted this performance audit from July 2008 to February 2010 in accordance with generally accepted government auditing standards. Those standards require that we plan and perform the audit to obtain sufficient, appropriate evidence to provide a reasonable basis for our findings and conclusions based on our audit objectives. We believe that the evidence obtained provides a reasonable basis for our findings and conclusions based on our audit objectives.

Martin Luther King, Jr.

Martin Luther King, Jr. (January 15, 1929 – April 4, 1968) was an American Baptist minister, activist, humanitarian, and leader in the African-American Civil Rights Movement. He is best known for his role in the advancement of civil rights using nonviolent civil disobedience based on his Christian beliefs. – “The ultimate measure of a man is not where he stands in moments of convenience and comfort, but where he stands at times of challenge and controversy — Strength to Love, 1963.”

Martin Luther King, Jr. (January 15, 1929 – April 4, 1968) was an American Baptist minister, activist, humanitarian, and leader in the African-American Civil Rights Movement. He is best known for his role in the advancement of civil rights using nonviolent civil disobedience based on his Christian beliefs.

King became a civil rights activist early in his career. He led the 1955 Montgomery Bus Boycott and helped found the Southern Christian Leadership Conference (SCLC) in 1957, serving as its first president. With the SCLC, King led an unsuccessful 1962 struggle against segregation in Albany, Georgia (the Albany Movement), and helped organize the 1963 nonviolent protests in Birmingham, Alabama. King also helped to organize the 1963 March on Washington, where he delivered his famous “I Have a Dream” speech. There, he established his reputation as one of the greatest orators in American history.

On October 14, 1964, King received the Nobel Peace Prize for combating racial inequality through nonviolence. In 1965, he helped to organize the Selma to Montgomery marches, and the following year he and SCLC took the movement north to Chicago to work on segregated housing. In the final years of his life, King expanded his focus to include povertyand speak against the Vietnam War, alienating many of his liberal allies with a 1967 speech titled “Beyond Vietnam“.

In 1968, King was planning a national occupation of Washington, D.C., to be called the Poor People’s Campaign, when he was assassinated on April 4 in Memphis, Tennessee. His death was followed by riots in many U.S. cities.

King was posthumously awarded the Presidential Medal of Freedom and the Congressional Gold Medal. Martin Luther King, Jr. Day was established as a holiday in numerous cities and states beginning in 1971, and as a U.S. federal holiday in 1986. Hundreds of streets in the U.S. have been renamed in his honor, and a county in Washington State was also renamed for him. The Martin Luther King, Jr. Memorial on the National Mall in Washington, D.C., was dedicated in 2011.

As promised, Dr. King returned to Memphis. He intended on leading a march despite the injunction against it. On April 3 Dr. King spoke at the city’s Mason Temple. With the shutters banging from the wind and thunder rumbling in the distance, Dr. King gave one of his most stirring speeches, and what would ultimately be his last.

Somewhere I read that the greatness of America is the right to protest for right.

And so just as I say, we aren’t going to let dogs or water hoses turn us around, we aren’t going to let any injunction turn us around.

Well, I don’t know what will happen now. We’ve got some difficult days ahead. But it really doesn’t matter with me now, because I’ve been to the mountaintop.

And I don’t mind.

Like anybody, I would like to live a long life. Longevity has its place. But I’m not concerned about that now. I just want to do God’s will. And He’s allowed me to go up to the mountain. And I’ve looked over.

And I’ve seen the Promised Land.

I may not get there with you. But I want you to know tonight, that we, as a people, will get to the promised land!

And so I’m happy, tonight. I’m not worried about anything. I’m not fearing any man!

Mine eyes have seen the glory of the coming of the Lord!!

Just hours before Mayor Muriel Bowser released a body-camera video depicting Metropolitan Police officers responding to the Smith incident, Ward 5 Councilmember Kenyan McDuffie introduced a bill that would increase training requirements for special police. There are nearly 17,000 such officers staffing housing projects, hospitals, and other properties in D.C. Many of these guards carry weapons and can issue arrests, and they undergo MPD certification.

District residents are still reeling from the death of Alonzo Smith, the 27-year-old found unconscious and in the custody of two special police officers last month at the Marbury Plaza Apartments. Now, a local legislator is seeking to establish more oversight of the private companies that provide contracted security services in D.C. There are currently more than 120 such companies operating.

D.C. Councilmember Proposes Stricter Special Police Officer Regulations

To require special police officers to undergo additional pre-appointment training on deescalation, bias-based policing, and interactions with disabled individuals, and individuals suffering from mental health and behavioral health conditions. To amend the D.C. Municipal Regulations to make the definition of campus comport with the federal Jeanne Clery Act. To allow campus police officers to exercise their authority on the campus of another university pursuant to a state of emergency declared by the Mayor or by the university’s president upon request by the university for assistance and notification to the Chief of Police of the Metropolitan Police Department (MPD). To allow campus police officers to wear their uniforms when traveling between university properties, attending court, or other official duties in support of the Metropolitan Police Department. To allow a campus police officer to exercise his or her authority outside the property he or she is appointed to pursuant to a public safety plan approved by the Chief of Police of MPD.

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 26 act may be cited as the “Special Police Officer Enhanced Security Amendment Act of 2015”

The Office for State and Local Law Enforcement (OSLLE) provides the Department with primary coordination, liaison, and advocacy for state, local, tribal, and territorial law enforcement agencies.

The Office for State and Local Law Enforcement (OSLLE) provides the Department with primary coordination, liaison, and advocacy for state, local, tribal, and territorial law enforcement agencies.

On the recommendation of the 9/11 Commission, Congress created the Office for State and Local Law Enforcement (OSLLE) in 2007 for two key purposes:

  1. Lead the coordination of DHS-wide policies related to state, local, tribal, and territorial law enforcement’s role in preventing, preparing for, protecting against, and responding to natural disasters, acts of terrorism, and other man-made disaster within the United States; and
  2. Serve as the primary liaison between DHS and non-Federal law enforcement agencies across the country.

The DHS State and Local Law Enforcement Resource Catalog highlights DHS resources available to state, local, tribal, and territorial law enforcement.  This document summarizes and provides links to training, publications, guidance, alerts, newsletters, programs, and services available to non-Federal law enforcement from across the Department.  The Resource Catalog is not exhaustive and will be updated on a bi-annual basis.

2015 Law Enforcement Conferences, Gatherings, and Meetings

The Office for State and Local Law Enforement (OCLLE) developed a list of law enforcement conferences, gatherings, and meetings in 2015.  These events often offer training opportunities and the ability to share best practices with law enforcement from across the country.  This document is not exhaustive.

Homeland Security Information Network

The Homeland Security Information Network (HSIN) is a national secure and trusted web-based portal for information sharing and collaboration between federal, state, local, tribal, territorial, private sector, and international partners engaged in the homeland security mission.  HSIN – Law Enforcement was developed specifically for the law enforcement community to share Law Enforcement Sensitive Information and to securely collaborate with partners across geographic and jurisdictional boundaries on topics such as weapons smuggling, narcotics trafficking, and gang mitigation.

Federal Law Enforcement Training Center:  State and Local Training

The Federal Law Enforcement Training Center (FLETC) provides tuition-free and low cost training to state, local, tribal, and territorial law enforcement.  Programs are conducted across the United States and are normally hosted by a local law enforcement agency.  Training is also conducted at FLETC facilities located in Glynco (Brunswick), GA; Artesia, NM; Charleston, SC; and Cheltenham, MD.

Homeland Security Grant Program

The Homeland Security Grant Program (HSGP) plays an important role in the implementation of the National Preparedness System (NPS) by supporting the building, sustainment, and delivery of core capabilities essential to achieving the National Preparedness Goal (NPG) of a secure and resilient Nation.  The building, sustainment, and delivery of these core capabilities are not exclusive to any single level of government, organization, or community, but rather, require the combined effort of the whole community.  The HSGP supports core capabilities across the five mission areas of Prevention, Protection, Mitigation, Response, and Recovery based on allowable costs.  HSGP is comprised of three interconnected grant programs:  State Homeland Security Program (SHSP), Urban Areas Security Initiative (UASI), and Operation Stonegarden (OPSG).  Together, these grant programs fund a range of preparedness activities, including planning, organization, equipment purchase, training, exercises, and management, and administration.

D.C. police force falls under 3,800 for first time in a decade

The number of D.C. police officers in the District has fallen below 3,800, its lowest level in a decade, breaking a threshold that top District officials once warned would be dangerously thin in a city that continues to grow.

As of Dec. 17, D.C. police had 3,786 officers, according to the mayor’s office, falling from more than 3,929 a year ago. Meanwhile this year, homicides across the District have surged more than 50 percent, and a spike in robberies in some neighborhoods instilled renewed fear of a return to the higher crime rates of the 1990s. Though police say violent crime is at its lowest level in seven years, residents polled put crime at the top of their worries this year.

Countering Violent Extremism, National Security and Terrorism

Violent extremists are defined as “individuals who support or commit ideologically-motivated violence to further political goals.” Violent Extremist threats within the United States can come from a range of violent extremist groups and individuals, including Domestic Terrorists and Homegrown Violent Extremists (HVEs). DHS defines Domestic Terrorism as: Any act of violence that is dangerous to human life or potentially destructive of critical infrastructure or key resources committed by a group or individual based and operating entirely within the United States or its territories without direction or inspiration from a foreign terrorist group.

Violent extremists are defined as “individuals who support or commit ideologically-motivated violence to further political goals.” Violent Extremist threats within the United States can come from a range of violent extremist groups and individuals, including Domestic Terrorists and Homegrown Violent Extremists (HVEs). DHS defines Domestic Terrorism as:  Any act of violence that is dangerous to human life or potentially destructive of critical infrastructure or key resources committed by a group or individual based and operating entirely within the United States or its territories without direction or inspiration from a foreign terrorist group. The act is a violation of the criminal laws of the United States or of any state or other subdivision of the United States and appears to be intended to intimidate or coerce a civilian population, to influence the policy of a government by intimidation or coercion, or to affect the conduct of a government by mass destruction, assassination, or kidnapping. A domestic terrorist differs from a homegrown violent extremist in that the former is not inspired by, and does not take direction from, a foreign terrorist group or other foreign power. DHS defines a HVE as: A person of any citizenship who has lived or operated primarily in the United States or its territories who advocates, is engaged in, or is preparing to engage in ideologically-motivated terrorist activities (including providing material support to terrorism) in furtherance of political or social objectives promoted by a terrorist organization, but who is acting independently of direction by a terrorist organization.

The threat posed by violent extremism is neither constrained by international borders nor limited to any single ideology.  Groups and individuals inspired by a range of personal, religious, political, or other ideological beliefs promote and use violence. Increasingly sophisticated use of the Internet, social media, and information technology by violent extremists adds an additional layer of complexity. Accordingly, DHS has designed a countering violent extremism (CVE) approach that addresses all forms of violent extremism, regardless of ideology, and that focuses not on radical thought or speech but instead on preventing violent attacks.  This approach provides numerous physical and virtual environments to promote information sharing and collaboration between Federal, State, Local, Territorial, Tribal, Private, Civilian, and International entities working to counter the threat of violent extremism.

DHS Priorities for Understanding and Countering Violent Extremism

Our approach to CVE emphasizes the strength of local communities.  We begin with the premise that well-informed and well–equipped families, communities, and local institutions represent the best defense against violent extremist ideologies.  And while our primary purpose is to prevent attacks by individuals or groups recruited by violent extremist organizations, or inspired by violent extremist ideologies, we also support strong and resilient communities as important ends themselves. The Department’s efforts are focused on three broad objectives:

Understand Violent Extremism – Support and coordinate efforts to better understand the phenomenon of violent extremism, including assessing the threat it poses to the nation as a whole and within specific communities;

Support Local Communities – Bolster efforts to catalyze and support community-based programs, and strengthen relationships with communities that may be targeted for recruitment by violent extremists; and

Support Local Law Enforcement – Deter and disrupt recruitment or individual mobilization through support for local law enforcement programs, including information-driven, community-oriented policing efforts, which for decades have proven effective in preventing violent crime.

To address these objectives, we work closely with our Federal and International partners, as well as our many partners at the Community, State, Local, Territorial, and Tribal levels across the country.  We are an important partner in supporting the White House’s National Strategyon Empowering Local Partners to Prevent Violent Extremism in the United States and the Strategic Implementation Plan (SIP) for Empowering Local Partners to Prevent Violent Extremism in the United States, which President Obama released in 2011; as well as the strategy for Implementing Recommendations of the 9/11 Commission Act of 2007.

Supporting Local Communities

Efforts to prevent crime, and in particular violent crime, are most effective when law enforcement establishes strong and trusting partnerships with community members themselves.  One important result of this is that community members will be more inclined to share suspicious information with law enforcement. As part of our effort to support local communities in countering violent extremism, DHS has launched a number of core initiatives:

DHS Outreach on CVE: In coordination with our Federal partners, DHS hosts conferences, workshops, and online forums for Federal, State, Local, Territorial, Tribal, Private Sector, Civilian community, and International partners in order to share information about CVE.

Training Initiatives: DHS, in collaboration with DOJ and State and Local law enforcement partners, has trained thousands of front line officers, first responders, and community leaders, and continues to provide CVE training to interested communities. These efforts work to improve communication, build trust, and encourage collaboration between officers and the communities they serve and protect. Training topics include effective policing without the use of ethnic or racial profiling, and best practices in community outreach.

Grants: DHS prioritizes CVE activities through grants that directly support State and Local partners and community outreach efforts to understand, recognize, report, and respond to potential indicators of terrorist activity.

Analysis and Research: DHS produces substantial analysis and research on trends in homegrown violent extremism, domestic terrorism, and terrorist propaganda to support Federal, State, Local, Territorial, and Tribal officials in identifying and mitigating violent extremist threats to the Homeland.

DHS CVE Structure and Office Functions

The Department’s CVE efforts have continued to adapt as the threat has evolved.  Efforts have been undertaken to catalogue, coordinate, and institutionalize CVE efforts and resources across DHS.  In furtherance of this, a CVE Working Group (reflecting the missions of components and equities across DHS) led by a CVE Coordinator has been formalized to oversee and coordinate all CVE activities.  The Department’s CVE efforts are comprehensive and fall into four function areas:

  • Policy Formation and Coordination Activities
  • Strategic CVE Activities (those explicitly conducted for the purpose of CVE)
  • CVE Support Activities (those that aid the department and its partners in conducting their CVE missions)
  • CVE-Relevant Activities (the regular activities of DHS components shaped to improve CVE or lessen the negative impact on CVE.  For instance, training of screeners, better redress procedures, and proper messaging of policies that could impact communities where VE occurs.)

The CVEWG is led by the CVE Coordinator and includes participation from the Office of Civil Rights and Civil Liberties (CRCL); Office of Intelligence and Analysis (I&A), Federal Emergency Management Agency (FEMA), National Protection and Programs Directorate (NPPD), Office of Policy, Office of Privacy (PRIV), and the Office of Science and Technology (S&T). The CVEWG also has members from DHS Components, such as Customs and Border Protection (CBP), Federal Law Enforcement Training Center (FLETC), Office of the General Counsel (OGC), US Immigration and Customs Enforcement (ICE), Office of Operations Coordination and Planning (OPS), Office of Public Affairs (OPA), Transportation Security Administration (TSA), US Citizenship and Immigration Services (USCIS), US Coast Guard (USCG), and the US Secret Service (USSS).

International Partnerships

DHS works with foreign governments, international organizations, and various U.S. Embassies across the world to develop and implement CVE programs.

DHS also has CVE partnerships with the Australia, Belgium, Canada, Denmark, Germany, Netherlands, Spain, the European Union, and the UK, as well as partnerships with international law enforcement organizations such as the International Association of Chiefs of Police (IACP), Europol, the Global Counter Terrorism Forum (GCTF), and the Hedayah Center.

  • DHS has developed and implemented Countering Violent Extremism (CVE) programs, such as the CVE Exchange Program. This program, in its third year, pairs two cities in the US with two in a European nation with exchange delegations representing civil society and local government exchanging operational community engagement best practices that may support CVE but also promote integration, youth empowerment, resolution of grievances, and protection of rights and liberties.
  • DHS signed a U.S.-Australia Joint Statement on Countering Transnational Crime, Terrorism, and Violent Extremism in Canberra in May 2012.
  • DHS, Europol, and EU partners have exchanged information on U.S. and EU information sharing and analytic best practices, CVE training standards, and research and case studies. In 2012, DHS and Europol released a joint assessment on the pathway to violence and operational planning of the terrorist responsible for the 2011 Norway attacks.
  • DHS has partnered with its Canadian counterparts to share best practices and research related to CVE, produce joint analysis, and promote community-based and community driven efforts.

Preventing Terrorism Overview

Protecting the American people from terrorist threats is the reason the Department of Homeland Security was created, and remains our highest priority.

Chemical Security

The manufacturing, use, storage, and distribution of chemicals must be secured from threats including terrorism and accidents. Some chemical facilities possess materials that could be stolen and used to make weapons. A successful attack on certain high-risk facilities could cause a significant number of deaths and injuries. The impacts of an accident or attack are far-reaching and can occur in a variety of ways.

Biological Security

We protect the nation’s health security by providing early detection and early warning of bioterrorist attacks.
